Welcome to BevAtlas (“BevAtlas,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of BevAtlas.com, including any company profiles, product pages, service pages, opportunities, dashboard tools, search tools, analytics, messaging tools, and related services we provide (together, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. About BevAtlas

BevAtlas is a business-to-business (“B2B”) platform for the beverage industry. The Services are intended for professional users, businesses, organizations, and trade participants, not general consumers.

BevAtlas helps beverage industry participants discover companies, products, services, and commercial opportunities. BevAtlas is not a broker, distributor, agent, marketplace operator, escrow provider, legal advisor, compliance advisor, or party to any transaction or business relationship between users.

We may update, modify, suspend, or discontinue parts of the Services at any time.

2. Eligibility

By using the Services, you confirm that:

  • You are at least the legal drinking age in your jurisdiction, or at least 18 where legal drinking age is not applicable.
  • You are using BevAtlas in a professional, business, organizational, or trade capacity.
  • You have authority to act on behalf of any company, brand, product, service, or opportunity you submit, claim, manage, or represent.
  • Your use of the Services complies with all applicable laws, regulations, licenses, and industry rules.

3. Accounts & Security

To access certain features, such as managing a company profile, posting opportunities, saving items, using dashboard tools, or responding to inquiries, you may need to create an account.

You agree to:

  • Provide accurate and up-to-date information.
  • Keep your login credentials confidential.
  • Notify us promptly of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, submit misleading information, misuse the Services, or otherwise create risk for BevAtlas, other users, or the integrity of the platform.

4. Company Listings, Claims, Verification & User Content

4.1 User Content

When you submit, claim, manage, edit, upload, link, post, or otherwise provide information through BevAtlas, including company listings, locations, products, services, opportunities, descriptions, images, videos, links, messages, or other materials (“User Content”), you confirm that:

  • You have the right and authority to submit that information.
  • The information is accurate to the best of your knowledge.
  • Your content does not infringe any third-party rights.
  • Your content does not violate applicable laws, regulations, licenses, advertising rules, alcohol beverage laws, trade rules, or platform policies.
  • You will keep your content accurate and updated where appropriate.

4.2 License to BevAtlas

You retain ownership of your User Content. By submitting User Content, you grant BevAtlas a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify for formatting and display, publish, display, distribute, index, analyze, and promote your User Content as necessary to operate, improve, protect, and market the Services.

This license allows BevAtlas to display your content in company pages, product pages, service pages, opportunity pages, search results, dashboard views, platform recommendations, and other BevAtlas features.

4.3 Moderation, Claims & Status Labels

BevAtlas may review, moderate, edit, reject, remove, merge, archive, or limit content at our discretion, including content that appears inaccurate, misleading, duplicative, incomplete, irrelevant, unlawful, offensive, promotional in a misleading way, or unrelated to the beverage industry.

BevAtlas may provide status labels such as “Verified,” “Claimed,” “Unclaimed,” “Pending,” “Needs Info,” or similar labels. These labels are informational platform signals only. They do not guarantee legitimacy, licensing, compliance, solvency, product authorization, inventory, product quality, business performance, or trustworthiness.

We may require additional information to process claims or verification requests and may deny, suspend, or revoke claims or verification at any time.

5. Product, Service & Company Relationships

Users may add, link, or manage products and services associated with a company profile.

By adding or linking a product or service to a company, you confirm that the company currently carries, imports, distributes, produces, represents, supplies, services, or otherwise has a legitimate business relationship with that product or service.

You may not add products, services, brands, or company relationships that are false, outdated, unauthorized, misleading, or intended to create inaccurate visibility.

BevAtlas may remove, unlink, moderate, or restrict product and service associations that appear inaccurate, duplicative, unsupported, or misleading.

6. Opportunities

BevAtlas may allow eligible companies to post commercial opportunities, including “Want,” “Offer,” or similar opportunity types.

6.1 Posting Eligibility

Only verified companies may post opportunities unless BevAtlas allows otherwise in writing or through platform controls.

By posting an opportunity, you confirm that:

  • You are authorized to post on behalf of the company.
  • The opportunity is accurate, lawful, and made in good faith.
  • The opportunity relates to legitimate beverage industry business activity.
  • You have the right to reference any products, services, markets, territories, trademarks, images, links, or business claims included in the post.
  • You are responsible for any communications, negotiations, agreements, obligations, or outcomes that result from the opportunity.

6.2 BevAtlas Is Not a Party to Opportunities

Opportunities are user-submitted business postings. BevAtlas does not guarantee that an opportunity is accurate, available, lawful, compliant, funded, licensed, authorized, or commercially viable.

BevAtlas is not a party to any communication, negotiation, transaction, distribution arrangement, representation agreement, purchase, sale, introduction, or business relationship arising from an opportunity.

Users are responsible for conducting their own due diligence before responding to, relying on, or entering into any arrangement based on an opportunity.

6.3 Opportunity Moderation

BevAtlas may review, edit, reject, expire, archive, unpublish, remove, or limit opportunities at our discretion, including opportunities that appear incomplete, inaccurate, misleading, unlawful, duplicative, spammy, expired, or inconsistent with the purpose of the platform.

Posting an opportunity does not guarantee visibility, ranking, responses, leads, transactions, or business results.

7. Smart Features, AI-Assisted Tools, Search & Recommendations

BevAtlas may provide search tools, Smart summaries, completeness signals, recommendations, ranking signals, AI-assisted copy suggestions, search interpretation, analytics, and other automated or semi-automated features.

These features are provided for informational, operational, and platform guidance purposes only.

You understand and agree that:

  • Smart features may be incomplete, inaccurate, delayed, or based on limited available information.
  • AI-assisted or automated outputs may require user review and correction.
  • Search results, rankings, completeness scores, recommendations, and visibility signals do not guarantee business outcomes, leads, sales, partnerships, compliance, or accuracy.
  • You are responsible for reviewing and approving any content before publishing or relying on it.
  • BevAtlas may use submitted content and platform activity to generate, improve, organize, classify, display, or recommend platform information.

BevAtlas does not guarantee that search results will include every relevant company, product, service, or opportunity, or that results will appear in a particular order.

8. Dashboard, Messages, Saved Items & Analytics

BevAtlas may provide dashboard tools that allow users to manage company information, view summaries, receive messages, save items, monitor activity, or access platform analytics.

Dashboard analytics, visibility indicators, engagement signals, completeness scores, message counts, saved items, and recommended next steps are informational only. They may be approximate, delayed, incomplete, or affected by technical, privacy, data availability, or platform limitations.

BevAtlas does not guarantee that any dashboard signal represents actual buyer intent, verified demand, sales opportunity, or future business result.

Messages, inquiries, saved items, and related dashboard interactions may be logged, routed, stored, reviewed, or moderated as needed to operate, secure, improve, and audit the Services.

9. Directory Data, Sources & Accuracy

Listings and other information on BevAtlas may come from:

  • Businesses themselves.
  • Public sources, including company websites and public directories.
  • Government or licensing registries.
  • Third-party data providers.
  • Users who submit, claim, or update company profiles.
  • Platform activity and submitted content.

We aim to keep information useful and current, but we do not guarantee that listings, products, services, opportunities, analytics, Smart outputs, or other data are complete, accurate, error-free, compliant, or up to date.

You use information on BevAtlas at your own risk. You are responsible for verifying information directly before making business, legal, compliance, purchasing, distribution, representation, or partnership decisions.

If you believe a listing or other content is inaccurate, please contact us so we can review it.

10. Contact Tools, Tickets & Communications

BevAtlas may offer tools that allow users to contact listed companies, respond to opportunities, receive dashboard messages, submit inquiries, and send support or moderation requests.

When you submit a message through our contact tools, opportunity response tools, dashboard tools, or support forms, we may create an internal record, including message content, ticket information, sender details, recipient details, timestamps, routing information, and related metadata, to help route, respond to, secure, and audit communications.

BevAtlas does not guarantee that a listed company or user will receive, respond to, or act upon messages.

Where a company does not have contact details on file or a contact tool is not enabled, the contact form may be unavailable, and the Site may display alternative contact options where available.

11. Optional Links, Video URLs & Third-Party Content

Users may be allowed to submit website links, social media links, video URLs, or other third-party references.

You are responsible for ensuring that any link or video URL you provide is accurate, lawful, appropriate, and authorized.

BevAtlas may display, remove, disable, or reject links or embedded content at our discretion.

Third-party websites, platforms, video services, social networks, maps, analytics providers, and external tools are governed by their own terms and privacy policies. BevAtlas does not control and is not responsible for third-party content, availability, accuracy, security, practices, or policies.

12. Acceptable Use

You agree not to:

  • Use BevAtlas for any unlawful, fraudulent, deceptive, misleading, or harmful purpose.
  • Submit false, unauthorized, outdated, or misleading company, product, service, or opportunity information.
  • Add products, services, or opportunities to companies you do not represent or have authority to manage.
  • Misrepresent licensing, verification, distribution rights, market access, inventory, product availability, certifications, or business relationships.
  • Harass, abuse, threaten, spam, or harm other users.
  • Attempt to scrape, harvest, copy, download, or bulk-extract data without our prior written permission.
  • Use automated tools, including bots, crawlers, scripts, or scraping systems, to access the Site in a way that imposes unreasonable load or circumvents platform controls.
  • Interfere with the normal operation, security, ranking, search, analytics, or integrity of the Services.
  • Inject malicious code, attempt unauthorized access, probe vulnerabilities, or bypass security controls.
  • Impersonate another person, company, organization, brand, or BevAtlas representative.
  • Use the Services to promote products, services, or activities that violate applicable alcohol beverage laws, trade rules, advertising restrictions, sanctions, or other regulations.

We may monitor usage and take appropriate action, including removing content, restricting features, suspending accounts, blocking access, or terminating use of the Services.

13. Intellectual Property

All content on the Site other than User Content, including text, graphics, logos, icons, software, layout, design, search functionality, Smart features, workflows, and platform structure, is owned by or licensed to BevAtlas and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, scrape, create derivative works from, or commercially exploit the Site or its content except as allowed by law or with our prior written permission.

14. Third-Party Links & Services

The Services may link to or integrate with third-party websites, tools, platforms, maps, analytics services, AI providers, video platforms, social media pages, payment providers, hosting providers, or other external services.

These third-party services are provided for convenience or functionality only. We do not control and are not responsible for:

  • The content of third-party sites.
  • Their privacy practices.
  • Their terms or policies.
  • Their availability or security.
  • Their accuracy or reliability.
  • Your use of third-party services.

Your use of third-party services is at your own risk and subject to their own terms and policies.

15. Disclaimers

To the maximum extent permitted by law:

  • The Services are provided on an “as is” and “as available” basis.
  • We do not promise that the Site or Services will be uninterrupted, error-free, secure, current, complete, or free of viruses.
  • We do not guarantee business outcomes, sales, leads, introductions, partnerships, rankings, visibility, responses, or results from using BevAtlas.
  • We do not guarantee the accuracy, completeness, legality, compliance, authorization, licensing, availability, or quality of any company, product, service, opportunity, message, user, listing, Smart output, search result, or third-party content.
  • Verification, claim status, search ranking, analytics, Smart recommendations, or platform labels are informational signals only and are not endorsements or guarantees.
  • You are responsible for verifying information, conducting due diligence, and making your own business, legal, compliance, financial, and operational decisions.

Nothing on BevAtlas constitutes legal, tax, financial, regulatory, compliance, import/export, licensing, alcohol beverage law, or professional advice. You should consult your own professional advisors for guidance specific to your situation.

16. Limitation of Liability

To the fullest extent permitted by law, BevAtlas and its owners, officers, employees, contractors, partners, and agents shall not be liable for any:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Loss of profits, revenue, data, goodwill, business opportunities, reputation, or anticipated savings.
  • Damages arising from inaccurate listings, user content, opportunities, communications, Smart outputs, search results, analytics, third-party services, or business decisions made using the Services.

This applies even if we have been advised of the possibility of such damages.

Where our liability cannot be excluded under law, it will be limited to the amount you paid to BevAtlas, if any, for the Services during the twelve (12) months immediately before the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless BevAtlas and its owners, officers, employees, contractors, partners, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Services.
  • Your User Content.
  • Your company, product, service, or opportunity submissions.
  • Your communications with other users.
  • Your violation of these Terms.
  • Your violation of any law, regulation, license, contract, or third-party right.
  • Any business relationship, transaction, dispute, or claim arising from your use of BevAtlas.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top indicates the latest revision.

Changes become effective when posted on this page. If you continue to use the Services after changes are posted, you agree to the updated Terms.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in California, United States, and you consent to the jurisdiction of those courts.
